Welcome to FriendStay Terms and Conditions

Parties

  1. FriendStay Pty Ltd is a shared housing accommodation provider based in New South Wales and also operating in Queensland, Australia under the ABN 20 638 324 875.
  2. You, as a natural person become a FriendStay housemate by accepting this agreement subject to strict compliance of FriendStay terms and conditions.

Agreement

  1. By accepting this agreement with FriendStay, you agreed to be bound by these terms and conditions.
  2. The term of this agreement is 12 weeks commencing on your moving in date. After this period, the agreement is renewed every 14 days unless FriendStay or you provide a written request to end the agreement 21 days prior the requested termination date.

Rent

Rent is payable fortnightly in advance at all times. The rent will be either deducted from your credit or debit card, or received by bank transfer. A penalty fee of AUD $ 10 will apply to your next fortnight payment if deduction is rejected or bank transfer is received 2 days after its due date.

If rent has not been received 4 days after its due date, this agreement is cancelled and you agree to vacate the premises within 3 days. Additionally, you agree for the whole security deposit to be used as a compensation for this rental loss.

You cannot sell nor transfer your agreement.

You will receive at least 21 days’ notice of changes in rent fees.

Security Deposit

A 2 weeks rent in advance and security deposit/bond of 2 weeks rent equalling must be paid on signing this agreement. Upon expiration of this agreement, the condition of the premises shall be examined. Any damage to the premises (beyond normal wear and tear) caused by you (or your guests), will be deducted from the amount of security deposit to be returned to you within two weeks of the expiration of this agreement.

Services

Payment for use of additional services such as cleaning or transport will be direct debited from your registered card once you request them via FriendStay’s portal.

An internet connection is available for unlimited access, however, FriendStay reserves the right to bar connection in the case of excessive or illegal use. The member acknowledges that the Services will be shared with other housemates of FriendStay. Not to abuse or mistreat any persons employed by FriendStay or damage or mistreat any equipment provided by FriendStay as part of the Services.

Use of water, electricity and gas

FriendStay agreement includes reasonable consumption of water, electricity and gas. However, if consumption goes beyond reasonable, FriendStay reserves the right to charge for the extra costs.

Insurance

You agree that you are solely responsible for the security of your property in the premises. It is your responsibility to secure your own property which you bring to the premise and for your own liability to third parties. FriendStay strongly recommends that you secure your property.

Termination

FriendStay has the right to terminate the agreement, withhold services including security deposit, restrict entry into the premise and shall have a general lien on all of your property physically situated on any part of FriendStay premises:

  1. where you have failed to pay for the rent or services in accordance with this agreement: or
  2. where you have breached any term of this agreement and fail to remedy that breach within 6 days of being requested by FriendStay to do so.

You are responsible for FriendStay’s reasonable costs in recovering any monies owed under this agreement. Upon the termination or determination of this agreement for any cause, you shall promptly and peacefully give vacant possession of the Premises in the condition and state of repair required under the section Use and Care of Premises of this Agreement and at the same time hand over all keys and access cards.

Use and Care of Premises Agreement

  1. To take care of the Premises and to keep it in a clean condition.
  2. To make no alterations or additions or install heavy equipment to the Premises without the written consent of Friend Stay.
  3. To ensure that nothing is done that might prejudice any insurance that the Landlord has in relation to the Premises.
  4. To ensure that rubbish or waste matter is not accumulated on the Premises and ensure all refuse and rubbish is regularly removed.
  5. Not to cause or permit a nuisance
  6. Not to smoke inside the Premises.
  7. Not to use the Premises for any immoral or illegal purposes.
  8. Not use of pets unless approved in writing by FriendStay.
  9. Not to cause or permit more people to reside in the premises than is permitted by this terms and conditions.
  10. Not to interfere, or cause or permit interference, with the reasonable peace, comfort or privacy of neighbours and members of FriendStay.
  11. not to intentionally or negligently cause or permit any damage to the premises.
  12. not to cause or permit people who are not authorised by FriendStay to occupy or reside in the premises
  13. To notify FriendStay as soon as practicable of any damage to the premises.
  14. FriendStay membership does not give the right to exclusively occupy the premises. FriendStay can access the premises (including rooms) at any time if necessary.
  15. FriendStay reserves the right to access the premises to show to prospective members or to certify the premises are in good condition.

Liability

To the maximum extent permitted under the law: 1. FriendStay, its related bodies corporate, their officers, employees, contractors and agents (“FriendStay Parties”) shall not be liable for any theft, loss or damage from the premise, howsoever occurring or for any damage done to the furniture or other effects of any other member in the premises by the caretaker, cleaners or any employees, contractors, agents or invitees of FriendStay. 2. The FriendStay parties shall not be liable for any loss, damage or loss of information resulting from communications or data failure including voice, communication and the Internet.

Inspections

Once your leave notice is activated, you accept to conduct inspections in your room with previous notification by text message. It is required to maintain your room organise for this inspections and also to organise access to the unit. In case one of your housamtes rooms is needed to be re rented, you accept us conducting inspection in common area also after text notification.

Repairs

To repair in a proper way any damage to the premises and fixtures and fittings resulting from neglect, omission or a deliberate or careless act or a breach of any condition of this agreement by the you or any person who enters or is upon the premises with your consent or sufferance. If he/she fails to do so FriendStay may do so at your expense. Invoices Any invoice issued by FriendStay to its housemates shall constitute a formal demand for payment. FriendStay retains the right to terminate this agreement, under the terms and conditions of this Agreement.

Cancelation and Refunds

You are entitled to cancel your membership at any time with a notice period of 28 days prior last day lodging a written request to FriedStay. If you request to cancel your membership less than 28 days, a standard cancellation rate of 100% of your 14 day membership fee will be deducted from security deposit. Refunds will be processed through FriendStay website and will only be processed to the credit card or bank account you made the original payment with.
